Trump describes process of how he declassified documents found at Mar-a-Lago

Former president’s office says there was standing order that classified memos automatically declassified if moved to residence

Donald Trump’s office told Just the News on Friday that the classified materials the FBI seized from his Mar-a-Lago estate were declassified under a “standing order” while he was president that allowed him to take sensitive materials to the White House residence at night to keep working.

The official statement is likely to become the focus of the president’s legal defense as the FBI and Biden Justice Department investigate whether he stole records covered under the Presidential Records Act or mishandled classified materials under the Espionage Act, allegations included in a search warrant released by a federal court in Florida on Friday.

The president’s defense is rooted in the legal principal that the president and vice president are the ultimate declassifying authority of the U.S. government and through executive orders most recently issued in 2003 by George W. Bush and Barack Obama in 2009 that specifically exempt the president and vice president from having to follow the stringent declassification procedures every other federal agency and official must follow.

Trump has maintained for weeks that any documents still containing classified markings in his possession after he left office were previously declassified. On Friday night, the statement issued to Just the News explained exactly how that declassification occurred in his mind.

The very fact that these documents were present at Mar-a-Lago means they couldn’t have been classified,” the former president’s office stated. “As we can all relate to, everyone ends up having to bring home their work from time to time. American presidents are no different. President Trump, in order to prepare for work the next day, often took documents including classified documents from the Oval Office to the residence.

“He had a standing order that documents removed from the Oval Office and taken into the residence were deemed to be declassified,” the statement added. “The power to classify and declassify documents rests solely with the President of the United States. The idea that some paper-pushing bureaucrat, with classification authority delegated BY THE PRESIDENT, needs to approve of declassification is absurd.”

Two former senior aides who worked for Trump in the latter half of his term said they were aware that Trump routinely took documents to the residence rather than return them to the Staff Secretary or the intelligence official who provided them. Asked whether there was a standing order, one former official “I don’t know anyone or anything that disputes that.”

Ordinarily, documents declassified by a president are later retrieved and marked declassified, usually by crossing a line through the prior classification markings. But former top aides to prior presidents acknowledged the president’s power to declassify was absolute and at times resulted in instant declassification decisions.

One prior administration official related an instance where his boss, while talking to a foreign leader, gave top-secret information to the leader, declassifying simply by sharing what he had seen in a top-secret marked document. Another official related an instance he witnessed in which a president, during a meeting, received a top secret document  and one official got up to leave because his clearance was only at the secret level.

“The president instantly approved that staffer to stay and consume the top-secret intelligence because it benefited the president’s work at that moment,” the person told Just the News.

The president’s detractors in Congress, the DOJ, and the intelligence community are likely to contest the president’s arguments. But officials familiar with national security law said courts generally have held the president’s power to declassify is far-reaching and that the process for how that happens can be more happenstance, something the Bush and Obama executive orders from 2003 and 2009 made clear.

Obama’s executive order no. 13526, issued in 2009, laid out the stringent process all federal officials and agencies needed to follow for declassification, but explicitly exempted the sitting president and vice president from having to follow those procedures.

 “Information originated by the incumbent President or the incumbent Vice President; the incumbent President’s White House Staff or the incumbent Vice President’s Staff; committees, commissions, or boards appointed by the incumbent President; or other entities within the Executive Office of the President that solely advise and assist the incumbent President is exempted from the provisions of paragraph (a) of this section,” the Obama order stated.

Officials said it is likely the FBI will seek to find any officials or witnesses who knew or can confirm there was a “standing order” as described by the Trump statement. But in the end, officials said the president’s declassification powers were sweeping and likely would be viewed as such by the courts.

Former national security official Kash Patel broke the ‘bad news’ to the FBI: The ‘classified’ documents it seized from Mar-A-Lago were already declassified.

“So, there’s a distinction between national security and criminal cases,” Patel said in an interview on Fox News. “And in this instance, it seems to be from the public reporting and the Attorney General’s conduct that this is going on pursuant to a national security investigation, which takes it out of the criminal division and into the national security division where I used to work.”

“And the receipts that are now becoming publicly available show vague descriptions of things, because the government is likely going to come in and say some of this stuff is classified, but it doesn’t seem to be the case, when Donald Trump issued sweeping declassification orders on multiple occasions… as president, on multiple times,” Patel said. “So that’s going to be a distinction that we need to watch for, and it’s incumbent upon the government, the DOJ to tell us what happened.”

“Okay,” host Martha MacCallum responded. “So you just touched on something that I wanna dig into here with you, which is the declassification process and what your position was at the time, and whether or not you were involved, because we know there’s a procedure that has to take place. The president can’t just, you know, sort of wave over a bunch of boxes and say, ‘this is all declassified.’ Can you take us through the process where these documents were declassified by this president?”

“Yeah, so the normal process, and I was the deputy, you know, there’s multiple occasions, but I think I was serving as Deputy Director of National Intelligence,” Patel replied. “If we needed to declassify through the normal chain of command for lower level employees, we’d have to go through a rigorous process to do that procedurally. But the president of the United States, is and has always been, the ultimate unilateral classification authority to classify and declassify. If he says something is declassified, that’s it. Then it’s declassified.”

“He issued a strong statement in October of 2020 to classify all Russiagate and all Hillary Clinton documents. And that’s up on, you know, publicly available,” he added. “And then at the end of his administration, in December and January, he felt so much more information needed to be classified. He declassified whole sets of documents that should have come out. Now, the GSA has since come out, the Government Services Administration, said they mistakenly packed some boxes and moved them to Mar Lago.”

“That’s not on the president, that’s on the National Archives to sort that material out.,” he added. “They cannot prosecute him for intentionally, even if it was classified, which it’s highly unlikely that the issue, these sweeping orders,  like we went through with the Hillary Clinton saga, they’ll never, they’ll never meet the burden of intent ,because president didn’t pack it up and take it himself. ”

“The GSA has said they did it and they made a mistake,” he added. “And that should have been really the end of it. It should have been a cordial subpoena, where at most where they said, ‘okay, we just need this and we’ll get the rest back to you.’ I mean, President Obama and President Clinton still have classified materials in their possession in their home, but they have not released to this day per the National Archive.”

“So are you saying that these particular documents that were at Margo were all declassified in that December, January period of what year?” MacCallum asked.

“The end of 2020 and early 2021, before the president left, whole sets of documents were, I don’t know what, was shipped down there because I wasn’t the GSA people moving those documents, only they do,” he said. “They packed them. They admitted that they packed them, which is their job and transported them there and stored them somewhere.”

“So the GSA can provide a lot more clarity to us on how and what was moved,” Patel added. “And the GSA could have worked with the Department of Justice. That would’ve been my move as the national security prosecutor who brought terrorism cases all the time. This is an extreme national security measure taken for what seems to be a wholly unnecessary national security approach.”

All right,” MacCallum said. “So you’re saying the GSA packed these boxes, they’ve already admitted that they sent some of them there in error. Yeah. So then, when, in June, when they went in with the subpoena and they collected the boxes, apparently then, you know, according to one line of this story, somebody said, ‘no, there’s actually more here and you need to come back for what is here because it shouldn’t be here.’ Do you think that is what happened? Do you think? And, the Secret Service individual who was involved in that is one of the storylines that we’re pursuing.”

“Yeah, I don’t know who that individual is, but I think it was clear from President Trump’s statements that I believe he put out on Truth Social that he invited, whoever was there in June or whatever date we’re talking about to this, to look and have whatever they want and come back, and I’m paraphrasing to see whatever they needed,” he went on. “So if that was the case, which it seems to be because the DOJ has not controverted that statement, then they could have come back because there’s a voluntary cooperation. I don’t know. I don’t have any details that immediate reporting in terms of that incident.

“But again, it seems to be, you know, there’s a different way to treat people regarding classified information, if your name’s Hillary Clinton or James Comey versus if your name is Donald Trump,” he said. “And it’s just not the even handed way to do it. It’s not how we used to do it at the Department of Justice.”

“And for the attorney general to come in heavy handed last night and say, ‘I personally signed off on the warrant,’ that’s not the role of the attorney general to tell the American public that,” Patel continued. “We know that. The role of the attorney general is to tell us ‘why in this, in this case, was it so necessary?’”

“And they, you know, I get me to the point of this whole conversation about nuclear information,” Patel noted. “Okay. Let’s just say, that’s the case. They waited two years to go seize this information? Or, and, and if, if they get away with the two year mark, how about the warrant was issued on Friday? And they executed on Monday. So it was so sensitive, they took the weekend off. I, as a national security prosecutor, would get these warrants and execute them the next minute. And I think you’ll find every national security prosecutor will tell you the same.”

Kash Patel raises an excellent point. As Breitbart News exclusively reported about the FBI search warrant, the Feds waited days to execute its raid after the document was approved.

“The warrant that authorized the search of former President Donald Trump’s residence at Mar-a-Lago shows it was issued by U.S. Magistrate Judge Bruce Reinhart on Aug. 5, 2022, at 12:12 p.m.—nearly three full days before the Justice Department and FBI conducted a raid to execute it,” Breitbart reported.

However, it is being reported elsewhere that the Biden administration may have moved to ‘reclassify’ the documents that were shipped to Donald Trump when he left the White House. If that is the case, and drawing on what Kash Patel said about the GSA packing the ‘wrong documents,’ the entire FBI raid may be yet another set-up.

Former President Trump on Wednesday announced that he would not be answering questions in his court-ordered deposition in New York Attorney General Letitia James’ three-year probe of his organization.

After arriving just before 9 a.m. at the AG’s NYC headquarters, Trump released a statement which reads in part: “accordingly, under the advice of my counsel and for all of the above reasons, I declined to answer the questions under the rights and privileges afforded to every citizen under the United States Constitution.

“I did nothing wrong, which is why, after five years of looking, the Federal, State and local governments, together with the Fake News Media, have found nothing,” the statement continues. “We cannot permit a renegade and out-of-control prosecutor to use this investigation as a means of advancing her political career.”

I once asked, ‘If you’re innocent, why are you taking the Fifth Amendment?” Now I know the answer to that question,” the statement continues.

Shortly before Trump’s deposition, he posted this to Rumble:

James had insisted that Trump be deposed in person, Insider reports, after her office issued its original subpoena in December while investigating whether the Trump Organization misstated the value of various properties on financial documents – which James alleges were then used to obtain tax breaks and bank loans.

James’ office is considering whether to file a civil suit against Trump, claiming in court filings that they have “uncovered substantial evidence establishing numerous misrepresentations” regarding Trump’s financial statements to banks, insurers and the IRS.

Trump’s legal team fought the December subpoena for more than six months – losing in both the State Supreme Court and in a Manhattan appeals court – after which the Trumps (Trump, Trump Jr., and Ivanka Trump) agreed to sit for depositions – which were delayed by the death of Ivanna Trump on July 14. Both Trump Jr. and Ivanka sat for depositions last week.

Trump’s refusal comes two days after the FBI raided his Mar-a-Lago home in Palm Beach, Florida – reportedly to find boxes of materials that the former president may have removed from the White House upon leaving office.

Trump slate sweeps Top Arizona Primary Races

Kari Lake wins Arizona GOP governor primary and is expected to face off against Katie Hobbs, who is currently Arizona’s Secretary of State

The Arizona GOP governor primary on Thursday evening was called for candidate Kari Lake, giving former President Donald Trump a clean sweep in the state in Tuesday night’s primaries.

She is expected to face off against Katie Hobbs, who is currently Arizona’s Secretary of State, to replace Republican Gov. Doug Ducey.

The Associated Press projected Lake as the winner with about 88.3% of the ballots counted. Lake came in with 46.8% of the vote. Lawyer Karrin Taylor Robson came in second to Lake with 44.0%.

Her victory is also a showdown between former President Trump and former Vice President Pence, the latter of whom endorsed Taylor Robson.

Lake celebrated her victory late Tuesday evening after a source told El American that she is the projected primary winner.

Lake, a former television news journalist, is known for her tough stance on the southern border.

“Kari will make her wonderful family, and the MAGA movement, very proud,” Trump said when he endorsed her.

Lake’s victory marked a perfect record for Trump-endorsed Republicans in the state’s major primary races. Venture capitalist Blake Masters claimed the party’s senatorial nomination while Mark Finchem won the secretary of state primary, and Abe Hamadeh won the attorney general primary contest.

Hungarian Prime Minister Viktor Orban, who has fiercely defended his country’s borders, language and culture, gave a 30-minute speech to a crowd of thousands of American admirers in Dallas on Thursday at the Conservative Political Action Conference (CPAC).

He painted a picture of America and Hungary facing twin fronts in a struggle against liberalism, globalists, communists, and “fake news.”

“The West is at war with itself,” he said, adding “The globalist can all go to hell. I have come to Texas.”

I can already see tomorrow’s headlines: Far-right European racist, anti-Semite strongman — the Trojan horse of Putin — holds speech at the conservative conference,” he said, to applause and laughter. “They did not want me to be here, and they made every effort to drive a wedge between us. They hate me and slander me and my country as they hate you and slander you,” Orban continued.

Orban also railed against illegal migration, saying “To stop illegal immigration, we have actually built that wall,” adding that his government was able to “reduce illegal migration to zero.”

Then, Orban discussed the importance of family and rejecting gender ideology, saying we need to “build a wall around our children” to protect against people who are targeting them.

To sum up, the mother is a woman, the father is a man – and leave our kids alone. Full stop, end of discussion!

He then said we need “less drag queens and more Chuck Norris,” to loud applause.

“These two locations will define the two fronts in the battle being fought for Western civilization,” he said, adding “Today we hold neither of them yet. We need both. You have two years to get ready.”

Twitter and COVID-19 vaccine makers have been peas in a pod for the past 18 months, with the former heavily policing claims about the latter’s products even when the source of evidence is the FDA.

But with federal acknowledgments that the vaccines play only a marginal role in mitigating COVID infection and transmission, and emerging evidence that their protections against hospitalization and death were oversold, the corporations are facing potential legal challenge, with repercussions for their bottom lines.

One Ivy League epidemiologist is predicting insurers will go after vaccine makers for misleading them about “all-cause mortality” in clinical trials, while another told Just the News his lawyer will soon threaten to file a class-action suit against Twitter.

Andrew Bostom, a longtime member of the Brown University medical faculty until last year, said he would be the named plaintiff in such a suit. He was suspended by Twitter twice in a month for sharing research on vaccine side effects.

Genomics researcher Kevin McKernan, who has endured repeated lockouts for questioning the evidence behind COVID vaccine claims, told Just the News he’s deciding between two attorneys, including former FDA Chief Counsel James Lawrence, who’s representing Bostom and previously got journalist Alex Berenson reinstated through litigation.

“Engaging [Twitter] before I’m actually banned will likely lack standing” to sue, McKernan wrote in an email. “Also keeping a close eye on Andrew Bostom.” Twitter didn’t respond to queries about the legal threats.

Twitter also recently suspended MIT senior research scientist Stephanie Seneff, who studies “the role of nutrition and environmental toxicants on human disease.” She’s the corresponding author on a new peer-reviewed paper on “innate immune suppression” by mRNA COVID vaccines.

In a July 19 notification Seneff showed Just the News, Twitter said she was being locked out for pointing followers to an essay by doctor Paul Alexander, also suspended by Twitter. The former Trump administration Health and Human Services official urged parents not to give their children COVID vaccines, which “subvert their innate immune system and can kill them.”

“I was probably a bit foolish” to share the article, Seneff wrote in an email, but “I am terrified of the future prospects of young children who are being injected with the COVID-19 experimental vaccines,” which she believes will “accelerate the rate of increase in autism over time.”

While she wrote an unsuccessful rebuttal challenging Twitter’s decisions, and called herself “frustrated” with Twitter’s “widespread censorship” of information about COVID vaccines, Seneff said she’s “not considering any legal steps at this time.”

This week, the company locked out vaccine researcher Jessica Rose for sharing a Vaccine Adverse Events Reporting System report on a 13-year-old girl who died less than a month after receiving a Pfizer vaccine dose.

McKernan said the three of them “have all published/attempted to publish” with COVID contrarian cardiologist Peter McCullough, who coauthored Seneff’s paper. “Usually faced academic gate keeping at the journal level,” McKernan said.

YouTube removed an interview with mRNA vaccine pioneer-turned-critic Robert Malone, as he predicted it would, less than three days after the Dutch podcast De Nieuwe Wereld posted the interview. An archive shows it had 42,000 views as of early Aug. 1.

Malone was joined by Dutch vaccine developer Theo Schnett, who described his new study, not yet peer-reviewed, that tested “the possibility of correlation of the booster vaccine campaigns (in the 60+ year cohort) in the Netherlands to excess all-cause mortality.” According to Malone, who posted the hour-plus interview on his own website, the study used the government’s “regional vaccination waves” as a “form of internal controls in the data analysis approach.”

YouTube owner Google, recently ordered by a federal judge to turn over internal documents in an antitrust lawsuit by Rumble, didn’t respond to queries about the video’s removal.

McKernan is on his final “strike” before suspension for telling another user vaccine trials didn’t have hospitalization or death as “endpoints,” which Twitter first deemed misinformation and then surreptitiously revised as “abusive behavior.” He’s since taken to highlighting abusive behavior against COVID contrarians left untouched by Twitter.

“Let’s see what @TwitterSupport does with a physician that mocks another minority physician regarding his childhood molestation,” McKernan wrote Tuesday, pointing followers to a tweet by University of Alabama Birmingham clinical assistant professor Joy Henningsen.

“Florida’s ‘Surgeon General,’” the Twitter-verified doctor wrote, using scare quotes, to share an interview with Joseph Ladapo, a skeptic of one-size-fits-all COVID vaccination programs, where he alleged he was molested as a child and recovered from the trauma through “Chinese healing techniques.”

Henningsen, who describes herself on LinkedIn as a “Passionate medical news contributor for both national and local news outlets,” made her Twitter account private soon after Just the News asked her to clarify the meaning of her quote-tweet, and didn’t answer an email query.

Twitter didn’t answer how Henningsen’s tweet compared to McKernan’s under its “abusive” prohibition.

“UAB recognizes individuals’ constitutionally protected rights to free speech … even when speech is counter to the institution’s vision, mission and values,” university spokesperson Bob Shepard told Just the News when asked if Henningsen’s tweet violated any academic or professional code. “Personnel matters are handled between the institution and employees.”

Yet again, it’s one rule for the elite and another rule for the plebs.

Prime Minister Justin Trudeau, who ensured mask mandates remain in place on planes for Canadians, was caught on camera with his entire family disembarking from a private jet having not worn a mask.

Canada remains one of the increasingly diminishing number of western governments that demands face masks be worn on flights, with the United States ditching the rule nearly four months ago.

When a Florida judge struck down U.S. version of the law, Trudeau’s government moved to insist that masks would still be required on Canadian airlines and on flights that depart from or arrive in Canada.

However, that rule doesn’t seem to apply to Trudeau himself.

A video showing Trudeau and his family disembarking from a private jet after it arrived in Costa Rica shows none of those who were onboard wearing a face mask.

One of Trudeau’s daughters even sneezes twice as she is greeted on the tarmac, despite Trudeau insisting that Canadians who have the sniffles should self-isolate.

This isn’t the first time Trudeau’s hypocrisy has caught up with him.

During a photo op aboard an Okanagan, B.C. steam train last month, the Canadian leader “was conspicuously maskless as he shook hands” with other passengers.

Despite the fact that the heritage train was not bound by federal transport regulations, Trudeau still faced criticism for failing to uphold the standards he expects others to meet.

Yet again, it’s one rule for the elite and another rule for the plebs.

Senate witness cites Fauci for ‘repeated demonstrably false’ denials

Rutgers molecular biologist Richard Ebright has previously accused NIAID and NIH directors of lying to the public.

In a Senate hearing on gain-of-function (GoF) research on viruses, which some scientists believe is responsible for the COVID-19 pandemic, longtime National Institute for Allergy and Infectious Diseases Director Anthony Fauci came in for particular scorn.

Dr. Fauci has made “untruthful” statements on “repeated occasions to the public, to the press and to policymakers,” Rutgers University molecular biologist Richard Ebright told the Senate Homeland Security Emerging Threats Subcommittee at a hearing Wednesday chaired by ranking member Sen. Rand Paul (R-Ky.), according to the Daily Caller.

“I do not understand why those statements are being made because they are demonstrably false,” Ebright continued, explaining that GoF research creates “new health threats … that did not exist previously and that might not have come to exist by natural means for tens, hundreds, thousands, or tens of thousands of years.”

At a May 2021 hearing of the Senate Health Committee, Fauci unequivocally denied a claim by Paul that the National Institutes of Health funded gain-of-function research at a Chinese lab widely suspected to be the source of SARS-CoV-2. NIH “has not ever and does not now fund gain of function research in the Wuhan Institute of Virology,” Fauci declared. He further denied that University of North Carolina virologist Ralph Baric was doing GoF research, while at the same time allowing that if he was, “it is according to the guidelines and is being conducted in North Carolina, not in China.”

It’s at least the second time Ebright has accused Fauci of lying, though previously he included Fauci in a group of lying officials.

NIH Principal Deputy Director Lawrence Tabak told the House Oversight Committee last fall that NIH-funded research at the Wuhan Institute of Virology using a modified bat coronavirus made mice “sicker” than the original virus, an “unexpected result of the research.”

Ebright said at the time this showed Fauci and NIH Director Francis Collins made “untruthful assertions” about not funding GoF research. 

“The NIH received the relevant documents in 2018 and reviewed the documents in 2020 and again in 2021,” his tweet stated. “The NIH — specifically, Collins, Fauci, and Tabak — lied to Congress, lied to the press, and lied to the public. Knowingly. Willfully. Brazenly.”

White House Coordinator for Strategic Communications at the National Security Council John Kirby was confronted Tuesday by Fox News correspondent Peter Doocy over the revelation that Al Qaeda has resestablished itself in Afghanistan following the Biden administration’s botched withdrawal from the country, handing it back to Taliban extremists.

Doocy first raised the issue of the administration claiming they knew Al Qaeda has a presence in Afghanistan despite Joe Biden’s claim last year that the terrorist organisation was “gone” from the country.

Kirby responded, “They weren’t playing a major role in operations or resourcing or planning in Afghanistan. But Peter, I know specifically because I was at a different podium a year ago and we talked about the fact that al-Qaida had a presence in Afghanistan, but small and not incredibly powerful or potent. And, I think, again without getting into numbers, we would still assess that to be the case.”

Doocy fired back, “So, we know that the Taliban was harboring the world’s most wanted terrorist. You guys gave a whole country to a bunch of people that are on the FBI Most Wanted List, what did you think was going to happen?”

Kirby responded, “I take issue with the premise that we gave a whole country to terrorist groups.”

“They were harboring the world’s number one terrorist, how is that not giving a country to a terrorist-sympathizing group, if not giving them permission to have terrorists just sit on a balcony?”  Doocy replied, referring to the revelation that Al Qaeda leader Ayman al-Zawahiri was reportedly killed by drone strike while relaxing in Kabul.

“Are we waiting for some spectacular terrorist attack in the U.S. to then say ‘oh, well there’s terrorists in a safe haven in Afghanistan, now we can go get them,’” Doocy further pressed.

In an interview the same day, Kirby admitted that Al Qaeda is now using Afghanistan as a “safe haven” again:

Reuters Just Fact Checked A Joe Biden Ice Cream Meme

The truth overlords conclude that the video has been “digitally edited.”

Reuters news agency has ‘fact checked’ a meme that shows Joe Biden wandering around looking lost while ice cream truck music (that someone dubbed over the top) plays in the background.

The footage is taken from an appearance by Joe Biden and his wife Jill Biden last year at a school in Washington DC.

At one point Biden wandered off momentarily while this wife was speaking, prompting someone to make the following funny meme:

The fun stops there however, as Twitter slapped a ‘manipulated media’ warning on it, and linked to a Reuters ‘fact check’:

Reuters further notes that “Biden can be seen walking out of frame and returning a few seconds later, but no ice cream truck can be seen in the video nor can any music be heard.”

The truth overlords conclude that the video has been “digitally edited.”

Phew, thanks for clearing that up.

This is not the first time memes have been subject to such ‘fact checks’ by the truth overlords.

These so called fact checkers aren’t impartial, independent outlets, they are merely hyper-partisan information attack dogs working on behalf of the regime.

According to this fact check, the definition of a recession isn’t being changed, even though the last ten times two consecutive quarters of negative GDP growth happened, a recession was declared.

As we highlighted last month, USA Today, which is used as a ‘fact checker’ by many social media platforms, was forced to delete 23 articles from its website after an investigation found one of its reporters had fabricated sources.
